PROFESSIONAL STAFFING AGREEMENT

TERMS OF SERVICE

Please read and acknowledge these terms before using our platform

KEY DEFINITIONS

These terms apply throughout our Professional Staffing Agreement:

  1. "Platform" means the Locum Force mobile application and associated services
  2. "Healthcare Provider" means healthcare facilities, clinics, hospitals, or medical practices using our platform
  3. "Healthcare Professional" means qualified medical practitioners registered with Locum Force
  4. "Assignment" means the temporary placement of a Healthcare Professional through our platform
  5. "Service Fee" means the placement charge outlined in section 3.1 below

References to singular include plural forms and vice versa, and references to any gender include all genders.

SERVICE AGREEMENT

1. CONTRACTUAL RELATIONSHIP

1.1 These Terms form the complete agreement between Locum Force and Healthcare Providers for connecting qualified healthcare professionals with temporary staffing needs, accessible through our mobile platform.

1.2 These Terms are automatically accepted when a Healthcare Provider requests professional services, interviews a Healthcare Professional, or shares their details with any third party. These Terms supersede any conflicting terms unless expressly agreed in writing by a Locum Force authorised representative.

1.3 Any modifications to these Terms must be documented in writing, signed by both parties, and include the effective date. No verbal agreements shall be binding.

1.4 Locum Force operates as an employment agency specialising in healthcare staffing solutions.

2. PLATFORM FEES

2.1 Healthcare Providers agree to pay Locum Force the standard placement fee calculated as:

  • £18 per day, per professional placement (plus VAT where applicable)

Payment is required upfront at the time of booking confirmation. This fee is non-refundable except as specified in section 6.2.

2.2 Healthcare Providers agree not to directly employ professionals introduced through the platform within 6 months without Locum Force involvement.

2.3 Where insufficient notice is provided to the Healthcare Professional regarding potential recruitment charges, the full Recruitment Charge remains payable.

2.4 If a placed professional introduces additional candidates who are subsequently engaged by the Healthcare Provider, the original Recruitment Charge terms apply.

3. CANDIDATE INFORMATION

3.1 Before introducing Healthcare Professionals, Locum Force will provide essential details including qualifications, experience, professional registration status, and availability to work the Assignment.

3.2 All candidate information is provided through detailed profiles accessible within the Locum Force mobile app. Healthcare Providers can review this information at any time before making booking decisions.

4. PROFESSIONAL PLACEMENTS

4.1 Locum Force facilitates payment processing between Healthcare Providers and Healthcare Professionals in accordance with the platform's compensation guidelines. Healthcare Providers are responsible for ensuring timely payment of professional fees and expenses.

4.2 The employment relationship exists directly between Healthcare Provider and Healthcare Professional. Locum Force bears no responsibility for compensation, tax obligations, or statutory requirements.

4.3 Healthcare Providers must ensure compliance with all applicable employment legislation, workplace safety regulations, and professional standards during assignments.

5. RISK MANAGEMENT

5.1 While Locum Force strives to connect Healthcare Providers with qualified, reliable professionals, we cannot guarantee performance outcomes or be liable for any losses arising from professional conduct, absences, or service quality issues.

5.2 Healthcare Professionals are independent contractors, not Locum Force employees. Healthcare Providers accept full responsibility for professional actions, errors, or omissions during assignments, including compliance with health and safety regulations and working time directives.

5.3 Healthcare Providers must indemnify Locum Force against all claims, costs, or liabilities arising from professional assignments, including injuries, illnesses, or damages occurring during service delivery.

5.4 Healthcare Providers are required to supply appropriate personal protective equipment, safety training, and working conditions. Assignments exceeding 48 hours per week must be pre-approved by Locum Force.

5.5 Healthcare Providers must disclose any concerns about a professional's suitability for their specific environment before assignment commencement.

5.6 Healthcare Providers indemnify Locum Force against all costs, claims, or damages resulting from professional misconduct or Terms violations.

6. ASSIGNMENT MANAGEMENT

6.1 Healthcare Providers must provide adequate supervision and evaluate professional performance. Dissatisfaction with service quality may result in immediate assignment termination or Locum Force-directed removal.

6.2 Healthcare Providers should notify Locum Force immediately if they wish to terminate an assignment due to performance concerns. Locum Force will work with the Healthcare Provider to arrange a suitable replacement where possible.

6.3 Healthcare Providers must immediately notify Locum Force of professional absences or inability to work, and in no case later than 24 hours after becoming aware.

6.4 Locum Force reserves the right to terminate assignments if we receive information indicating professional unsuitability.

7. GENERAL PROVISIONS

7.1 Acceptance of professional services through our platform constitutes acceptance of these current Terms of Service.

7.2 These Terms are governed by English law and subject to the exclusive jurisdiction of English courts.
